These Terms of Service set forth the terms and conditions for using Gumson (gumson.com) (the "Service"), an image-to-HTML conversion service operated by Beauty Again Co., Ltd. (the "Operator," "Company," or "we"). They apply to all users who access or use the Service (each, a "user").
Article 1 (Preamble)
1.1. The Operator runs the following brand and website: Gumson (gumson.com)—a web-based service that converts image-only product detail pages, catalogs, and documents into editable, searchable, responsive HTML.
1.2. By signing up for or using the Service, you agree to these Terms. For users purchasing credit plans (one-time purchases), our Refund Policy applies in addition to these Terms.
1.3. In these Terms, "Output" refers to all deliverables generated by the Service analyzing and reconstructing images uploaded by the user ("Input"), including HTML, CSS, image assets, and layer data.
Article 2 (Eligibility and Usage Rights)
2.1. Output generated using free credits (such as sign-up credits, free previews, or samples) may only be used for personal, non-commercial purposes and for evaluating the Service. Output generated with paid credits may be freely used, including for direct or indirect commercial purposes.
2.2. The Operator reserves the right to restrict Service access or block users without disclosing reasons to ensure stable Service operation and protect other users.
2.3. Users agree that the Operator may store their IP addresses to monitor and detect excessive use of the Service.
2.4. Children under the age of 14 may not sign up for or use the Service. In these Terms, a "child" refers to any individual under 14 years of age (or below the minimum age required by applicable local law to independently consent to personal data processing).
Article 3 (User Rights and Obligations)
3.1. Users shall not engage in any activity that compromises the functionality or operation of the Service. Specifically, scanning or probing software vulnerabilities, circumventing security controls, gaining unauthorized access to Service systems, or injecting malicious code is strictly prohibited.
3.2. Users represent and warrant that they hold all necessary rights (including copyrights, neighboring rights, industrial property rights, trademark rights, and portrait/publicity rights) or valid licenses for the images they upload. Users assume full responsibility for converting and commercially using third-party detail pages, designs, or photographs without authorization from the rights holder.
3.3. Users may not share a single account across multiple individuals, nor transfer or lend an account to others. Users are solely responsible for maintaining the confidentiality and management of their account credentials.
Article 4 (Acceptable Use)
4.1. Users shall not directly or indirectly upload content, generate Output, or use the Service for any of the following:
- Promoting or creating a risk of physical or psychological harm, emotional distress, death, or disability to oneself, others, or animals
- Promoting or creating a risk of property damage or loss
- Harming or exploiting children
- Engaging in harassment, abuse, racial or ethnic slurs, defamation, invasion of privacy or portrait rights, or threats
- Discriminating against or inciting/promoting discrimination based on race, religion, sex, sexual orientation, age, disability, origin, nationality, etc.
- Displaying or linking to nudity, sexually explicit material, or pornography
- Selling or promoting illegal activities, products, or services
- Engaging in or promoting fraudulent schemes or deception
- Infringing on individual or third-party rights, including intellectual property and privacy rights
- Containing information or content that the user has no legal, contractual, or fiduciary right to disclose
- Disseminating false, deceptive, or misleading information or promoting disinformation
- Violating applicable laws or promoting illegal activity
- Threatening or undermining democratic processes or institutions
The Operator reserves the right to determine at its sole discretion whether content violates this Article, and this Article may be updated from time to time.
Article 5 (Usage Restrictions)
5.1. Users shall not use the Service in any manner contrary to its intended purpose.
5.2. Users shall not, directly or through any third party: (i) lease, sell, distribute, resell, sublicense, or provide the Service on a service bureau basis (except as permitted under these Terms); (ii) reproduce, decompile, reverse engineer, attempt to extract source code from, modify, or create derivative works of the Service or any part thereof; (iii) access the Service for performance benchmarking purposes; (iv) access the Service to build or market a competitive product; (v) use the Service to store or transmit viruses or malicious code; (vi) mine, extract, or scrape data from the Service or its content for any purpose, including machine learning; or (vii) circumvent any measures implemented by the Operator to prevent or restrict access, including usage or copy protection controls.
5.3. When using the API, users are responsible for managing their issued API keys. Users assume full responsibility for credit deductions and any consequences arising from compromised or leaked API keys.
Article 6 (Content Review, Conversion Results, and Appeals)
6.1. Users remain solely responsible for any content they upload to the Service. The Operator does not guarantee pre- or post-upload review of all user content.
6.2. The Operator may review user content via automated tools and personnel, and will investigate content reported as potentially unlawful or in violation of these Terms.
6.3. Anyone may report content on the Service. Reporting instructions are provided in Article 11.
6.4. If a user disagrees with a moderation decision made by the Operator, they may submit an appeal via email (support@rebeauty.co.kr). Appeals must be submitted within 6 months of the decision date.
6.5. Upon receipt of an appeal, the Operator will review it in a timely, non-discriminatory, diligent, and non-arbitrary manner, reverse the decision if the initial determination is found to be erroneous, and promptly notify the user of the outcome and remedies. The Operator reserves the right to remove content from the Service at any time and for any reason at its sole discretion, especially defective files, low-quality content, content that violates these Terms, or content raising legal concerns.
6.6. The Operator may provide content owned by the Operator or third parties (including sample images, templates, and AI-generated content) as part of the Service. Certain original sample images in the Service gallery are captures of third-party reference materials provided solely for layout and markup reference. Users may not sell or distribute such images on a standalone basis.
6.7. "Standalone" means a state substantially identical to what is displayed on the Service without creative additions. Merely applying filters, altering colors, resizing, or cropping constitutes standalone use; combining the asset with other images, text, illustrations, or editing techniques to create a new original work does not.
6.8. Conversion Output is generated by artificial intelligence and automated pipelines. Users are responsible for their Input and the resulting Output, and shall not attempt to bypass any safeguards or content protection controls implemented by the Operator. Users shall not use the Service or Output for any of the following purposes:
- Misrepresenting AI-generated content as human-made
- Creating deepfakes or impersonating others to deceive
- Removing, altering, or disabling attribution or metadata in Output
- Generating or using Output in violation of applicable laws
- Creating deceptive or misleading political or election-related content
- Creating sexually explicit content, nudity, or content sexually objectifying or exploiting minors
- Generating or disseminating information that infringes on or restricts the fundamental rights and freedoms of others
- Creating any other harmful content that violates these Terms
6.9. Users are responsible for their Input (such as uploaded images and URLs) and the resulting Output (such as HTML). Users represent and warrant that they possess all rights, licenses, and permissions necessary to submit and use the Input with the Service. As between the user and the Operator, to the extent permitted by law:
- The Operator claims no ownership rights in user Input.
- Output is owned by the user. However, ownership of Output does not guarantee that every component may be used for all purposes (e.g., commercial use). Output may include third-party content (e.g., third-party photos, logos, or fonts present in the Input) that the Operator cannot license.
- Users are responsible for ensuring that their use of Input, Output, and any content contained therein complies with applicable rights and licenses.
- Users grant the Operator a royalty-free license to display, host, reproduce, store, and use Input and Output solely to the extent necessary to provide the Service.
- When using Output, users must comply with these Terms, and do so at their own risk.
- The Operator may impose limits on the volume of Output users can generate based on credits or other criteria.
6.10. Certain content (including samples, templates, and AI-generated content) may involve third-party intellectual property rights (copyrights, trademarks, design rights), moral rights, portrait/publicity rights, or privacy rights. Examples include identifiable individuals, logos, brands, products, architecture, and fonts. Users are solely responsible for determining whether third-party consent or licensing is required prior to using such content, and the Operator makes no warranties and expressly disclaims all liability regarding such authorizations.
6.11. AI and automated conversion may produce errors. The Operator does not verify the accuracy of Output (including text recognition, layout fidelity, colors, or links), and Output does not represent the views of the Operator. Users are responsible for evaluating the accuracy and suitability of Output for their intended purposes. The Operator makes no warranties as to the accuracy, completeness, or reliability of Output and disclaims all liability arising from the use of Output or any omissions or errors contained within it. We recommend professional review before using Output commercially or publishing legal, medical, or financial information.
Article 7 (Warranties and Liability)
7.1. All warranties regarding Output and Service availability are excluded. To the extent any warranty claim is recognized by mandatory law, such claim shall be limited to a period of 6 months.
7.2. The Operator is not liable for the processing speed, availability, data loss, or accuracy of results related to the Service and software. Furthermore, the Operator's liability is excluded unless damages result from the Operator's willful misconduct or gross negligence. This limitation does not apply to damages for injury to life or body.
7.3. In any event, the Operator's total liability shall be limited to the amount actually paid by the user for the Service during the 12 months immediately preceding the event giving rise to damages, or ₩100,000 if no payment was made.
7.4. The Service and all content provided through it are provided "AS IS." The Operator makes no warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose, regarding the content (including third-party content and links), the Service, Service speed, software, availability, information accuracy, or rights/licenses under these Terms. The Operator does not warrant or represent that the Service or content will meet user requirements or operate uninterrupted or error-free. The Operator shall not be liable to users or third parties for any general, punitive, special, indirect, consequential, or incidental damages, lost profits, or other damages, costs, or losses resulting from the use of the Service, guidance, or content.
7.5. Notwithstanding the foregoing, nothing in these Terms restricts user rights guaranteed under mandatory provisions of applicable laws, including the Framework Act on Consumers and Korea's Act on Consumer Protection in Electronic Commerce.
Article 8 (Indemnification)
8.1. To the extent permitted by law, users shall defend, indemnify, and hold harmless the Operator, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, costs, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (i) user breach of these Terms or (ii) user use of the Service.
Article 9 (Confidentiality and Privacy)
9.1. Details on how personal data is processed on the Service can be found in our Privacy Policy. Information regarding cookie use is set forth in our Cookie Policy.
9.2. Images uploaded by users and the resulting Output are processed solely to provide the Service, and are never made public unless the user creates a shareable link or consents to publication in the gallery.
Article 10 (Term and Termination)
10.1. These Terms become effective upon the user's first access to the Service and remain in effect until the user's account is deleted or terminated.
10.2. If the Operator reasonably determines that a user or their use of the Service violates these Terms, the Operator may take one or more of the following actions: (i) remove prohibited user content; (ii) suspend Service access; (iii) terminate and delete the account; (iv) permanently ban Service access; and/or (v) report prohibited content or activities to relevant authorities. Upon termination, user rights to use the Service terminate immediately. Users expelled by the Operator are prohibited from accessing the Service again.
10.3. Users may delete their account at any time via account settings or by submitting a request to support@rebeauty.co.kr. Remaining credits upon account deletion will be handled in accordance with the Refund Policy.
Article 11 (Reporting and Appeal Procedures)
11.1. The Operator maintains a single contact point for reporting unlawful or infringing content. Please email support@rebeauty.co.kr with "Report Illegal Content" in the subject line.
11.2. Please include the following details in your report:
- Reasons why the content is believed to be unlawful or infringing (including specific laws or rights violated)
- The URL of the content, plus any additional details to help locate and identify it
- The reporter's name and email address (optional)
- A statement affirming that the report is accurate and complete to the best of your knowledge
11.3. If you believe the Operator took erroneous action against your account or content, you may submit an appeal to support@rebeauty.co.kr within 180 days of the action date. Copyright infringement reports and counter-notices are handled pursuant to procedures established under the Copyright Act.
11.4. Requests from law enforcement or government authorities must be submitted to the channel above and will be processed in accordance with statutory requirements and procedures.
Article 12 (Payments and Credits)
12.1. Service usage is deducted in credits (1 credit = ₩100, 100 credits = ₩10,000). HTML conversion consumes 10 credits per 1,000,000 px² (1,000×1,000) of image area (width in pixels × height in pixels), calculated proportionally and rounded up to the nearest whole credit (e.g., 57.3 credits → 58 credits). Image Studio (image regeneration, text-to-image, image translation, text/OCR translation) consumes 1 credit per execution, regardless of feature, page count, or resolution. Credits used for failed conversions or generations are refunded automatically.
12.2. Credits are one-time purchases and do not renew automatically. Purchased credits have no expiration date and are added to your existing credit balance upon each purchase.
12.3. Pricing and credit policies are published on our Pricing Plans page, and prior notice will be given for any changes. Revised prices apply to purchases made after notice is posted.
12.4. Refunds are governed by our Refund Policy.
Article 13 (Miscellaneous)
13.1. These Terms and any legal disputes arising from the use of the Service shall be governed by the laws of the Republic of Korea.
13.2. Jurisdiction over disputes arising out of or in connection with these Terms or the Service shall be determined under the Civil Procedure Act; provided, however, that disputes with non-consumer users shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
13.3. The Operator may modify these Terms (and any policies or agreements referenced herein) at any time. The Operator will post updated Terms on the Service, and will provide notice of material changes affecting user rights or Service usage via in-service announcements or account email at least 7 days prior to the effective date (or 30 days prior for changes adverse to users). Continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms.
13.4. If any provision of these Terms is found to be invalid, unenforceable, or unlawful, the remaining provisions shall continue in full force and effect. In such event, the parties shall replace the invalid provision with a valid provision that most closely reflects the economic purpose of the original provision.
13.5. Any translation of these Terms into a language other than Korean is provided solely for convenience; in the event of any conflict or inconsistency in interpretation, the Korean version shall govern.
